General Terms and Conditions for Service and Repair

1. General


1.1 Scope
These terms and conditions apply to all service and repair work performed by Erich Stallkamp ESTA
GmbH for its customers. Any deviating or supplementary agreements require
written confirmation by Erich Stallkamp ESTA GmbH. The terms and conditions agreed here shall also
apply if conflicting customer terms and conditions are known and the service has been provided
without reservation.

1.2 Scope of services
The services include all necessary work for the diagnosis, repair, and maintenance of
devices. By sending the item to be repaired to Erich Stallkamp ESTA GmbH, consent is deemed to
have been given for disassembly for the purpose of fault diagnosis. If the product is subsequently
returned without any repairs being carried out, a separate diagnosis fee of EUR 250 will be charged.

1.3 Condition upon delivery
The customer is obliged to deliver the device sent for diagnosis or repair in a thoroughly cleaned
condition. The device will be inspected upon receipt. If it is determined that the device is not in a
reasonably clean condition, Erich Stallkamp ESTA GmbH reserves the right to charge a flat cleaning
fee in accordance with Section 4.2. If cleaning by Erich Stallkamp ESTA GmbH is necessary, the
customer shall bear the costs incurred.
Proper cleaning is a prerequisite for carrying out diagnostic and
repair work. Erich Stallkamp ESTA GmbH is entitled to suspend processing of the device until it has
been completely cleaned.

2. Conclusion of contract


A contract is concluded as soon as the customer orders a service or repair and Erich Stallkamp ESTA
GmbH accepts this by confirming the order, agreeing on a date, or shipping the goods or providing
the service. Orders can be placed by telephone, e-mail, via
digital customer portals, or in person.
A repair order is placed when the customer accepts a cost estimate previously prepared by Erich
Stallkamp ESTA GmbH.

3. Diagnosis and disassembly, repair approval, and handling of disassembled devices


3.1 Diagnosis and disassembly
Disassembly of the device may be necessary as part of the diagnostic examination. The customer
agrees to this measure by sending in the device. All associated costs and potential risks, such as
complete functional failure, will be disclosed to the customer in advance.

3.2 Repair approval
Once the diagnosis has been completed, the customer will be presented with a repair quote detailing
the defects found. The customer then has a period of 6 weeks to approve the repair or request the
return of the device.

3.3 Return in disassembled condition
If no repair order is placed and the customer requests a return, this will be carried out.
Basically in its current, disassembled state. This is done with reference to the condition of the device,
unless separate reassembly has been requested.

3.4 Reassembly as an additional service
If the customer wishes to have the device returned in assembled condition, reassembly will be
charged as a separate service. The customer will be informed of the costs incurred for this before
reassembly.

4. Acceptance period and obligation to bear costs


4.1 Acceptance period
If the customer does not respond within the 6-week period specified in section 3.2, the device will be
returned to them.

4.2 Costs for return shipment
In the case of section 4.1, the customer shall bear the costs of the return shipment.

4.3 Cleaning costs
If the device is delivered in an uncleaned condition, Erich Stallkamp ESTA GmbH is entitled to charge
a flat fee of EUR 150 per device for the necessary cleaning.

5. Prices


5.1 Price basis
All deliveries and services are subject to the prices current at the time of performance of the service
in accordance with the valid price list. This can be found on the homepage of Erich
Stallkamp ESTA GmbH (https://www.stallkamp.de/) and can be accessed there by logging in. If the
customer does not have access to this area, Erich Stallkamp ESTA GmbH will send them a price list on
request.

5.2 Travel and additional costs
A flat rate will be charged for travel to and from the site in accordance with the price list mentioned
in section 5.1. Additional services, such as reassembly or work
outside normal working hours, will be invoiced separately in accordance with the price list in Section
5.1.

6.Warranty and limitation of liability


6.1 Warranty
Erich Stallkamp ESTA GmbH grants a warranty of one year on the work performed, starting from the
date of delivery or, if acceptance is required, from the date of acceptance. This period does not apply
to claims for damages by the customer arising from injury to life, limb, or health, or from intentional
or grossly negligent breaches of duty by the seller or
its vicarious agents, which are subject to the statutory limitation periods.

6.2. Limitation of liability
Erich Stallkamp ESTA GmbH shall only be liable for intent and gross negligence, except in cases of
breach of material contractual obligations, injury to life, limb, or health, or claims under the Product
Liability Act. Material contractual obligations are those whose fulfillment is necessary to achieve the
purpose of the contract.
To the extent permitted by law, Erich Stallkamp ESTA GmbH's liability to entrepreneurs for lost
profits, pure financial losses, and/or consequential damages (due to defects) is expressly excluded.
Furthermore, no reimbursement of costs for working time or transport costs will be made if the
dealer acts independently.

7. Warranty claims


7.1. Warranty
If the repair is to be carried out within the scope of warranty claims, proof of a legally valid purchase
contract must be provided, which proves the date of delivery of the device to the customer. The
respective return form and the associated checklist must be
must be completed in full and enclosed. Contractual provisions deviating from this regulation
Agreements remain unaffected and take precedence in the respective agreement.

7.2 Costs in the event of a lack of warranty claim
If, after the goods have been sent in, it transpires that the case is not covered by the warranty, Erich
Stallkamp GmbH shall be entitled to invoice the costs and fees incurred up to that point. Upon
request, the customer shall receive a cost estimate in accordance with Section 3.2.

8. Retention of title


Until all services have been paid for in full, all installed accessories, spare parts, and assemblies
remain the property of Erich Stallkamp ESTA GmbH.


9. Data


9.1 Data
Erich Stallkamp ESTA GmbH collects, processes, and stores all data necessary for the fulfillment of the
contract in accordance with the applicable data protection regulations (in particular the GDPR).

9.2 Purpose of data processing
The data collected will be used exclusively for the purpose of executing the contract, providing
services, and—with the express consent of the customer—for marketing purposes.

9.3 Revocation of consent
The customer may revoke their consent to data processing in writing at any time.

10. Applicable law and place of jurisdiction


10.1 Choice of law
The law of the Federal Republic of Germany applies.

10.2 Place of jurisdiction
For disputes relating to contracts with consumers, the place of jurisdiction shall be the consumer's
place of residence. For contracts with entrepreneurs, the place of jurisdiction shall be the competent
court at the registered office of Erich Stallkamp ESTA GmbH, 49413 Dinklage, Germany.

11. Final provisions


11.1Written form requirement
Amendments or additions to these service and repair terms and conditions must be made in writing.
This also applies to any amendment to this clause.

11.2 Severability clause
Should any provision of this contract be wholly or partially invalid or unenforceable, the validity of
the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be
replaced by a provision that comes as close as possible to the economic purpose of the
original provision as closely as possible.
